REQUEST FOR COMMENTS ON THE DRAFT PREVENTION OF ILLEGAL EVICTION FROM AND UNLAWFUL OCCUPATION OF LAND AMENDMENT BILL, 2026

The Western Cape Government welcomes and fully supports the leadership shown by the Minister of Human Settlements, Thembi Simelane, in publishing the Prevention of Illegal Eviction from and Unlawful Occupation of Land Amendment Bill for public comment.

This important legislative intervention comes at a critical time when unlawful land and building occupations are placing severe pressure on municipalities, communities, government resources, and private property owners. Between 2019 and 2024 the Western Cape Department of Infrastructure (DOI) spent over R1 billion on securing projects against unlawful occupation across the province – funds that could have created thousands of housing opportunities.

The proposed amendments demonstrate a balanced and responsible approach by strengthening law enforcement mechanisms while preserving the dignity and rights of vulnerable people who may require alternative accommodation.

We particularly support measures aimed at addressing organised land invasions, unlawful profiteering from land sales, and those who exploit desperate citizens by inciting illegal occupations. These actions undermine lawful development, service delivery, and public confidence in the rule of law.

The Minister’s commitment to public participation, transparency, and nationwide consultation is commendable. By allowing 60 days for public submissions and engaging communities directly, the process reflects democratic governance and inclusive policy-making.
