UNLAWFUL SALE AND DONATION OF WATER (UPDATED 05 FEB 2026)

It has come to the attention of the Langeberg Municipality that certain individuals are selling water to residents for irrigation and other purposes.

In terms of the National Water Act, 36 of 1998, water is a national resource held in trust by the State and may not be privately owned, sold, or traded. Water use authorisations do not allow holders to sell or transfer water to third parties.

The Water Services Act, 108 of 1997, further provides that no person may supply water to others without the written approval of the relevant Water Services Authority.

In addition, the Langeberg Municipality Water Services By-law stipulates that only the Municipality or an authorised water services provider may supply water. The unauthorised use, transfer, or sale of municipal water is an offence and may result in fines, enforcement action, and the restriction or disconnection of water services.

Following consultation with the Central Breede River Water User Association (CBRWUA) and the Breede-Olifants Catchment Management Agency (BOCMA), the Municipality confirms that donations of water are possible under specific conditions: 
- Irrigation water (Breede River Scheme): Permission and approval must be obtained from the CBRUA. 
- Borehole water: The borehole must be registered or certified with BOCMA, and the donation must be verified and approved by the Langeberg Municipality in collaboration with BOCMA. 

Water cannot be sold by any person or company without the necessary licence. 
 The transportation of water off-site, even when provided as a donation, requires prior authorisation to ensure compliance with legislation and water quality standards. 
Humanitarian or emergency donations are considered only on a case-by-case basis and require written approval from the Municipality. 

Residents are requested to report any suspected unlawful water trading or unauthorised water transportation to the Langeberg Municipality. Where possible, photographic evidence, including a visible vehicle registration number, will assist with investigations.

The Municipality will take all necessary steps to ensure compliance with applicable legislation and protect our shared water resources.
