REQUEST FOR DIRECTIVE IN TERMS OF SECTION 30A OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT, 1998 (ACT NO. 107 OF 1998) (“NEMA”) IN RESPECT OF AN EMERGENCY SITUATION: EMERGENCY FLOOD DAMAGE REPAIRS.

1. The Department of Environmental Affairs and Development Planning (DEA&DP) is the competent authority implementing the NEMA and the NEMA Environmental Impact Assessment Regulations, 2014 (as amended) (“NEMA EIA Regulations”) in the Western Cape.

2. Flood events may result in damage to the bed and banks of watercourses, as well as infrastructure such as bridges, culverts, pipelines, erosion protection works, and related structures located within or adjacent to watercourses. The repair or rehabilitation of damaged watercourses or infrastructure may trigger one or more activities listed in the NEMA EIA Regulations, which require environmental authorisation prior to its implementation.

3. With the approach of the Western Cape Province’s high rainfall season and potential associated flood events, DEA&DP wishes to provide guidance on the procedure to request for a NEMA S30A Emergency Directive for repair and rehabilitation works within and adjacent to watercourses, which may be required as a result of flood damage. 4. While the NEMA EIA Regulations require environmental authorisation to be obtained before any of the listed activities may be undertaken, Section 30A (“S30A”) of NEMA makes provision for the competent authority to direct a person verbally or in writing to carry out a listed or specified activity, without obtaining an environmental authorisation in order to prevent or contain an emergency situation or to prevent, contain or mitigate the effects of the emergency situation.

4. In terms of S30A of NEMA, an “emergency situation” means “a situation that has arisen suddenly that poses an imminent and serious threat to the environment, human life or property, including a 'disaster' as defined in section 1 of the Disaster Management Act, 2002 (Act No. 57 of 2002), but does not include an incident referred to in
section 30 of this Act.”

5. It is important to note that S30A of NEMA does not apply in the event that a person has already commenced with a listed activity in terms of the NEMA EIA Regulations without prior authorisation.

6. Emergency directives issued by the competent authority in terms of S30A are only for listed activities in the NEMA EIA Regulations. An emergency directive does not absolve applicants from their general “duty of care” set out in Section 28(1) of the NEMA. Furthermore, the person requesting a S30A directive (“requester”) would still need to comply and/or obtain approval in terms of any other relevant legislation.

7. Procedure to request a S30A directive:

7.2. Provide the following minimum information to the Director via WhatsApp:
a) Details of the person requesting the S30A directive and that of the landowner, if it is not the same person.
b) Details of the property including Farm/Erf Name and Number, area, name of river
c) Description of the damage that occurred, including location details and GPS coordinates (if available at that time).
d) Photographs of the damage that occurred.
e) Description of the repair or rehabilitation work that will be required.
f) Confirmation that the infrastructure to be repaired was constructed lawfully.
g) Indication of the risk to the environment, human life or property if the damage is not repaired urgently.

8. If a verbal S30A is granted, the requestor must complete the attached Request for S30A Directive Form and submit it to the relevant Directorate within 24 hours of obtaining the verbal directive. 9. Once the Request for S30A Directive Form has been submitted, DEA&DP will confirm the verbal S30A in writing. The written S30A directive will set out the details of the approved repair and/or rehabilitation work, as well as any conditions that may be applicable in the specific circumstances, including the period for which the directive is valid.

10. Submitting a request for a S30A directive does not imply automatic approval. Each request will be assessed on its own merits, in line with Section 30A of NEMA and GN No. R.310 of 10 April 2015.

11. Due to the urgency associated with an emergency situation, all submissions will be treated as a priority. DEA&DP will respond within the shortest possible timeframe, depending on the completeness of the information provided.

12. Where a Maintenance Management Plan (MMP) has already been adopted for the affected area, this must be clearly indicated, as it may expedite the assessment process. The contact details of the holder of the MMP must be provided.

Notice is hereby given in terms of Section 49 (1) (a) (i) of the Local Government: Municipal Property Rates Act, 2004 (Act No. 6 of 2004), hereinafter referred to as the “Act”, that the 6th supplementary valuation roll for the financial year 2025/2026 is open for public inspection at the municipal venues listed below, from 12 May 2026 to 12 June 2026.

An invitation is hereby made in terms of Section 49 (1) (a) (ii) of the Act that any owner of property or other person who so desires, should lodge an objection with the municipal manager in respect of any matter reflected in, or omitted from, the valuation roll within the abovementioned period.

Attention is specifically drawn to the fact that in terms of Section 50 (2) of the Act an objection must be in relation to a specific individual property and not against the valuation roll as such.  The form for lodging an objection is obtainable at the following address or website:
