CALL FOR COMMENTS ON THE APPLICATION TO NERSA FOR THE APPROVAL OF ELECTRICITY TARIFFS FOR THE 2026-27 FINANCIAL YEAR 

Notice is hereby given in terms of sections 22(a), 23 (a) and 24 (2) (c) (ii) of the Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003) and section 21 of the Local Government: Municipal Systems Act, (Act 32 of 2000) that the Municipality will submit FY2026/27 tariff application to National Energy Regulator (NERSA) with an increase of 14.4% on the tariffs based on Langeberg Municipality’s cost of supply study:

The National Energy Regulator (NERSA) is an organ of state entrusted with the mandate to approve electricity tariffs in terms of the Electricity Regulation Act, 2006 (Act No. 4 of 2006) as amended of licensed distributors including municipalities.

Electricity Regulation Act as amended (ERAA) prescribes principles that govern the setting and approval of tariffs. These include the requirement that tariffs and revenues must enable an efficient licensee to recover the full cost of its licensed activities, including a reasonable margin or return.

In terms of the Municipal Finance Management Act, 2003, municipalities are required to submit their electricity tariffs to the NERSA for approval on or before 15 March for implementation by 1 July of that same year. 

The Municipality’s current tariffs are expiring on 30 June 2026 and there is no automatic extension as the tariffs are annually approved. To enable compliance with the decision making by NERSA and implementation of the decision in line with the provision of the ERAA and MFMA, NERSA advised Langeberg Municipality to submit FY2026/27 tariff applications on or before 12 December 2025.

Notice is hereby further given in terms of Section 21 and 21A of the Local Government: Municipal Systems Act, 2000 (Act 32 of 2000) that the local community and affected parties are invited to submit comments or representations on the FY2026/27 Electricity Tariffs that are based on the municipality’s cost of supply study.

Such comments or representations must be submitted by not later than the 5th of December 2025 at 12:00. Comments received after the closing time will not be considered.

Written or electronic comments must be submitted for the attention of the Municipal Manager by 05 December 2025 clearly marked “COMMENTS ON THE APPLICATION TO NERSA FOR THE APPROVAL OF ELECTRICITY TARIFFS FOR THE 2026/27 FINANCIAL YEAR”
