NOTICE: IMPLEMENTATION OF FIBRE WAYLEAVE POLICY

Langeberg Municipality hereby informs all Fibre Network Operators (FNOs), Internet Service Providers (ISPs), Electronic Communications Network Service (ECNS) licensees, contractors, developers, and other interested parties that all fibre-related wayleave applications will be processed in accordance with the Council-approved Langeberg Municipality Wayleave Policy, effective 01 July 2026.

Wayleave Application Requirements

Applications must be submitted on the prescribed Fibre Wayleave Application Form, available from Municipal Offices and the Municipal website (https://www.langeberg.gov.za/notices/municipal-notices/6635-public-notice-implementation-of-fibre-wayleave-application-process/file.html), and must include all required supporting documentation, including but not limited to:

-       Detailed route drawings showing the full extent of the proposed fibre deployment.

-       Locality plans and utility service information.

-       Proposed reinstatement details.

-       Method statements and construction methodologies.

-       Traffic Management Plans, where applicable.

-       Environmental Impact Assessments and/or Heritage Impact Assessments, where required by legislation.

-       Details of all required third-party approvals and proof thereof.

-       Compliance statements and supporting agreements as required by the Policy.

-       Information relating to infrastructure sharing or co-location, where applicable.

Application Fees

Applicants are advised that Municipal wayleave application fees are payable in accordance with the Municipality’s approved tariffs. Upon receipt of a wayleave application form, the Municipality will issue an invoice to the applicant for the applicable wayleave application fee.

Applications will only be assessed for completeness once the required documents have been submitted and payment of the prescribed application fee has been received. Wayleave application fees are non-refundable.

Processing of Applications

Complete applications must be submitted to the ICT department – This email address is being protected from spambots. You need JavaScript enabled to view it.. The Municipality will acknowledge receipt and advise within five (5) working days whether the application is complete or requires additional information.

Fibre wayleave applications will generally be processed within 30 working days from the official submission date. Where additional assessment time is required, applicants will be notified in writing, and the processing period may be extended by a maximum of a further 30 working days.

Important Notice

No excavation, trenching, installation, maintenance, or related fibre works may commence within the Municipal area without an approved wayleave permit issued by Langeberg Municipality. The Municipality’s approved tariffs include penalties for non-compliance or damage to infrastructure.

KENNISGEWING: IMPLEMENTERING VAN VESELWEGVERLOFBELEID

Langeberg Munisipaliteit stel hiermee alle Veselnetwerkoperateurs (VNO's), Internetdiensverskaffers (ISP's), Elektroniese Kommunikasienetwerkdiens (EKNS) lisensiehouers, kontrakteurs, ontwikkelaars en ander belangstellende partye in kennis dat alle veselverwante wegverlofaansoeke verwerk sal word in ooreenstemming met die Raad-goedgekeurde Langeberg Munisipaliteit se Wegverlofbeleid, effektief vanaf 1 Julie 2026.

Vereistes vir Wegverlofaansoeke

Aansoeke moet ingedien word op die voorgeskrewe Veselwegverlofaansoekvorm, beskikbaar by Munisipale Kantore en die Munisipale webwerf, en moet alle vereiste ondersteunende dokumentasie insluit, insluitend maar nie beperk tot:

-       Gedetailleerde roetetekeninge wat die volle omvang van die voorgestelde veselontplooiing toon.

-       Liggingsplanne en inligting oor nutsdienste.

-       Voorgestelde herinstellingsbesonderhede.

-       Metodeverklarings en konstruksiemetodologieë.

-       Verkeersbestuursplanne, waar van toepassing.

-       Omgewingsimpakstudies en/of Erfenisimpakstudies, waar deur wetgewing vereis.

-       Besonderhede van alle vereiste goedkeurings van derde partye en bewys daarvan.

-       Nakomingsverklarings en ondersteunende ooreenkomste soos vereis deur die Beleid.

-       Inligting met betrekking tot die deel van infrastruktuur of mede-lokasie, waar van toepassing.

Aansoekfooie

Aansoekers word in kennis gestel dat munisipale wegverlof aansoekfooie betaalbaar is in ooreenstemming met die Munisipaliteit se goedgekeurde tariewe. Na ontvangs van 'n wegverlof aansoekvorm, sal die Munisipaliteit 'n faktuur aan die aansoeker uitreik vir die toepaslike wegverlof aansoekfooi.

Aansoeke sal slegs vir volledigheid beoordeel word sodra die vereiste dokumente ingedien is en betaling van die voorgeskrewe aansoekfooi ontvang is. Wegverlof aansoekfooie is nie terugbetaalbaar nie.

Verwerking van Aansoeke

Volledige aansoeke moet by die IKT-afdeling ingedien word - This email address is being protected from spambots. You need JavaScript enabled to view it.. Die Munisipaliteit sal ontvangs erken en binne vyf (5) werksdae in kennis stel of die aansoek volledig is of bykomende inligting benodig.

Veselwegverlof aansoeke sal oor die algemeen binne 30 werksdae vanaf die amptelike indieningsdatum verwerk word. Waar bykomende assesseringstyd benodig word, sal aansoekers skriftelik in kennis gestel word, en die verwerkingstydperk kan met 'n maksimum van 'n verdere 30 werksdae verleng word.

Belangrike Kennisgewing

Geen opgrawings, slootgrawings, installasie, onderhoud of verwante veselwerke mag binne die Munisipale gebied begin sonder 'n goedgekeurde wegpermit uitgereik deur Langeberg Munisipaliteit nie. Die Munisipaliteit se goedgekeurde tariewe sluit boetes in vir nie-nakoming of skade aan infrastruktuur.

Iimfuno zeSicelo se-Fibre

Izicelo mazingeniswe kwiFomu yeSicelo se-Fibre esimiselweyo, esifumaneka kwiiOfisi zikaMasipala kunye neqonga lezaziso likaMasipala, kwaye kufuneka siquke onke amaxwebhu axhasayo afunekayo, kuquka kodwa kungaphelelanga apho:

-       Imizobo eneenkcukacha zendlela ebonisa ubungakanani obupheleleyo bokusetyenziswa kokwakhiwa kwe-fibre okucetywayo.

-       Izicwangciso zendawo kunye nolwazi lwenkonzo yombane.

-       Iinkcukacha zokubuyiselwa ezicetywayo.

-       Iingxelo zendlela kunye neendlela zokwakha.

-       Izicwangciso zoLawulo lweNdlela, apho kufanelekileyo.

-       Uvavanyo lweMpembelelo kwiNdalo kunye/okanye uVavanyo lweMpembelelo kwiLifa, apho kufunwa ngumthetho.

-       Iinkcukacha zazo zonke iimvume ezifunekayo zomntu wesithathu kunye nobungqina bazo.

-       Iingxelo zokuthobela imithetho kunye nezivumelwano ezixhasayo njengoko kufuneka kwiMigaqo-nkqubo.

Iintlawulo zeSicelo

Abafaki-zicelo bayacetyiswa ukuba iintlawulo zesicelo sokwakha fibre kuMasipala zihlawulwe ngokuhambelana neerhafu ezivunyiweyo zikaMasipala. Emva kokufumana ifomu yesicelo sokwakha fibre, uMasipala uya kukhupha i-phepha lentlawulo kumfaki-sicelo yentlawulo yesicelo esifanelekileyo.

Izicelo ziya kuvavanywa kuphela ukuba ziphelele na xa amaxwebhu afunekayo engenisiwe kwaye intlawulo yentlawulo yesicelo emiselweyo ifunyenwe. Iintlawulo zesicelo sokwakha i-fibre azibuyiselwa.

Ukucutshungulwa kwezicelo

UMasipala uya kuvuma ukuba zifunyenwe kwaye azise zingadlulanga iintsuku ezintlanu (5) zokusebenza ukuba isicelo sigqityiwe okanye sifuna ulwazi olongezelelweyo.

Izicelo zokwakha i-Fibre ngokubanzi ziya kucutshungulwa zingadlulanga iintsuku eziyi-30 zokusebenza ukususela kumhla wokungeniswa ngokusemthethweni. Apho kufuneka ixesha elongezelelweyo lovavanyo, abafaki-zicelo baya kwaziswa ngokubhaliweyo, kwaye ixesha lokucubungula linokwandiswa ngeentsuku eziyi-30 zokusebenza ezingaphezulu.

Isaziso esibalulekileyo

Akukho msebenzi wokwemba, wokufaka imijelo, wokufakela, wokulungisa, okanye we-fibre enxulumene noko onokuqalwa ngaphakathi kummandla kaMasipala ngaphandle kwemvume yokungena evunyiweyo ekhutshwe nguMasipala waseLangeberg. Iirhafu ezivunyiweyo nguMasipala ziquka izohlwayo zokungathobeli okanye ukonakalisa iziseko zophuhliso.
